{"id":78,"date":"2021-05-14T05:36:21","date_gmt":"2021-05-14T05:36:21","guid":{"rendered":"https:\/\/siyuancreative.com\/sg\/?page_id=78"},"modified":"2021-05-14T05:47:57","modified_gmt":"2021-05-14T05:47:57","slug":"hrpolicy","status":"publish","type":"page","link":"https:\/\/siyuancreative.com\/sg\/hrpolicy\/","title":{"rendered":"HR Policy"},"content":{"rendered":"<body>\n<p style=\"font-size:24px\"><strong>Contract Addenda<\/strong><\/p>\n\n\n\n<p><strong>Senior Worker Early Adopter<br><\/strong>These are the new commitments that\u00a0<strong>Si Yuan Creative<\/strong>\u00a0(\u201cthe Company\u201d) will be fulfilling, with effect from\u00a0<strong>10th May 2021<\/strong>:<\/p>\n\n\n\n<p>(i)\u00a0 \u00a0The Company will be\u00a0<strong>raising the retirement age to 65<\/strong>, internally (the \u201cinternal retirement age\u201d), and replacing the prevailing minimum retirement age set out at Section 4 of the Retirement and Re-employment Act (Cap. 274), 2012 Revised Edition (\u201cRRA\u201d). \u00a0The Company will agree to offer to\u00a0<strong>re-employment from internal retirement age until 70 age<\/strong>\u00a0(\u201cinternal re-employment age\u201d), replacing the prevailing ages set out at Section 7A of the RRA.<\/p>\n\n\n\n<p>(ii)\u00a0 \u00a0This means that the Company\u00a0<strong>will not dismiss employees below age 65<\/strong>\u00a0on the account of age, and is obliged to\u00a0<strong>offer re-employment to eligible employees from age 65 to age 70<\/strong>. The other eligibility criteria for re-employment will follow those set out in section 7 of the RRA and the Tripartite Guidelines on the Re-employment of Older Employees.<\/p>\n\n\n\n<p>(iii)\u00a0 \u00a0The Company will fulfil the same employment and re-employment obligations required under the RRA towards all employees until they reach the internal retirement age or internal re-employment age.<\/p>\n\n\n\n<p>(iv)\u00a0If the Company does not meet their commitment to:<\/p>\n\n\n\n<p>a.\u00a0 \u00a0the higher internal retirement age, the Company agrees that the employee will be entitled to remedies under the RRA.<br>b.\u00a0 \u00a0the higher internal re-employment age, the Company will pay the employee an employment assistance payment under the RRA. The quantum of employment assistance payment will be determined based on the principles set out in the Tripartite Guidelines on the Re-employment of Older Employees or relevant employment document (e.g. employment contract, Collective Agreement, the Company\u2019s human resource policy), whichever is higher.<\/p>\n\n\n\n<p>(v)\u00a0 \u00a0These terms would be binding on the Company and all employees. The Company will not vary these terms in any way resulting in these terms to be less favourable to the employee. These terms will be valid until such time more favourable terms are prescribed by legislation.<\/p>\n\n\n\n<p><strong>Part-Time Re-employment<br><\/strong>These are the new commitments that\u00a0<strong>Si Yuan Creative<\/strong>\u00a0(\u201cthe Company\u201d) will be fulfilling with effect from\u00a0<strong>10th May 2021<\/strong>:<\/p>\n\n\n\n<p>(i)\u00a0 \u00a0In addition to and without prejudice to the Company\u2019s obligations to offer re-employment to eligible employees under Part III of the Retirement and Re-employment Act (Cap. 274), 2012 Revised Edition (\u201cRRA\u201d), the Company will also offer part-time re-employment to eligible employees upon their request. All employees eligible for reemployment will be eligible for part-time re-employment.<\/p>\n\n\n\n<p>(ii)\u00a0 \u00a0If the Company is not able to find a suitable part-time vacancy to re-employ the eligible employee upon his\/her request, the Company will pay an employment assistance payment to the employee as though Part III of the RRA applies, pro-rated based on the reasonable number of hours a part-timer works per week. The quantum of employment assistance payment will be determined based on the principles set out in the Tripartite Guidelines on the Re-employment of Older Employees or relevant employment document (e.g. employment contract, Collective Agreement, the Company\u2019s human resource policy), whichever is higher.<\/p>\n\n\n\n<p>(iii)\u00a0 \u00a0These terms would be binding on the Company and all employees. The Company will not vary these terms in any way resulting in these terms to be less favourable to the employee.
